Telephone canvassing

Consumers who do not wish to be the subject of commercial prospecting by telephone can register free of charge on a list opposing telephone canvassing.
Right of withdrawal
The Customer is informed that, in application of articles L. 121-16-1 and L. 121-21-8 12° of the Consumer Code, with regard to either tourist packages or accommodation services (other than residential accommodation), goods transport services, vehicle rental, catering or leisure activities which must be provided on a specific date or period, the services offered are not subject to the application of the right of withdrawal provided for in articles L. 121-21 et seq. of the Consumer Code regarding distance selling.
Consequently, the services ordered on the website or via the telephone platform are exclusively subject to the cancellation and modification conditions provided for in the General Conditions of Sale and/or in any Special Conditions of Sale.
Law on confidence in the digital economy 2004-575 of June 21, 2004
- Article 14 defines electronic commerce:
“E-commerce is the economic activity by which a person offers or ensures the supply of goods or services remotely and electronically.
Also included in the scope of electronic commerce are services such as those consisting of providing online information, commercial communications and search tools, access and retrieval of data, access to a communications network or hosting of information, including when they are not remunerated by those who receive them…”
- Article 19 requires easy-to-access and permanent notices on the site:
“Without prejudice to other information obligations provided for by the legislative and regulatory texts in force, any person who carries out the activity defined in Article 14 is required to ensure to those for whom the supply of goods or the provision of services is intended easy, direct and permanent access using an open standard to the following information:
1° If it is a natural person, their first and last name and, if it is a legal person, their company name;
2° The address where it is established, its email address, as well as telephone details allowing you to actually get in touch with it;
3° If it is subject to registration formalities in the trade and companies register or in the trade directory, its registration number, its share capital and the address of its head office;

Any person who carries out the activity defined in Article 14 must, even in the absence of a contract offer, when mentioning a price, indicate it clearly and unambiguously, and in particular whether taxes and delivery costs are included…”
Consumer Code:
- general obligation of pre-contractual information (art R 111-1):
In addition to the information above, professionals must indicate the payment terms offered to the consumer, as well as the terms provided for processing complaints.
- obligation to provide information on the fact that the right of withdrawal does not apply to
outdoor hotel accommodation, provided for in article L. 221-5 which stipulates that:
“Prior to the conclusion of a contract of sale or supply of services, the professional communicates, in a readable and understandable manner, the following information: … 5° When the right of withdrawal cannot be exercised in application of article 221-28, information according to which the consumer does not benefit from this right or, where applicable, the circumstances in which the consumer loses his right of withdrawal”
- obligation to provide information on the BLOCTEL system (art L 223-2):
“When a professional is required to collect telephone data from a consumer, he informs him of his right to register on the list opposing telephone canvassing.
When this collection of information is done at the time of the conclusion of a contract, the contract mentions, in a clear and understandable manner, the existence of this right for the consumer. »
Obligation to provide information on online reviews (art L111-7-2):

Without prejudice to the information obligations provided for in Article 19 of Law No. 2004-575 of June 21, 2004 for confidence in the digital economy and in Article L. 111-7 of this code, any natural or legal person whose activity consists, primarily or incidentally, of collecting, moderating or disseminating online opinions from consumers is required to provide users with fair, clear and transparent information on the terms of publication. and processing reviews posted online.
It specifies whether or not these opinions are subject to control and, if this is the case, it indicates the main characteristics of the control implemented.
It displays the date of the notice and any updates.
It indicates to consumers whose online review has not been published the reasons justifying its rejection.
It sets up a free feature which allows those responsible for products or services that are the subject of an online review to report a doubt about the authenticity of this review, provided that this report is justified.
A decree, taken after consulting the National Commission for Information Technology and Liberties, sets the terms and content of this information.
In accordance with V of Article 64 of Law No. 2024-449 of May 21, 2024, these provisions come into force on February 17, 2024.
Escapade Vacances uses a review aggregator for the Moulin de César and the Cloître des Dominicains: Customer Alliance without moderation on our part. For Suze Luxe Nature, we respond to reviews posted on our Google My Business, Secureholiday, Tripadvisor and Booking page without moderation. In the event of a doubtful review, we make a complaint on the platform on which the review was posted.
